Why do I need to register my Agency to text with my clients?

While it has become accepted practice to respond to customers when they initiate a conversation to conduct business, consent to communicate ends when the conversation is completed for that specific question or particular transaction. It is illegal for an Agency to start any conversation with a customer via text unless that customer has opted in to receive texts first. 

As texting occurs across the “telephony” network, all Business (B2P) or Application-initiated (A2P) text messaging is subject to Federal Communications Commission (FCC) regulations based on the Telephone Consumer Protection Act (TCPA) and Cellular Telephone Industries Association (CTIA) guidelines, particularly those involving consent to receive and delivered message content.

The Campaign Registry (TCR) began in March 2020, with the final ruling coming from the FCC in January 2021. These regulations were enacted in March 2021 and have been modified several times. Each time they were modified, additional consumer protections were added to prevent unwanted text messages. 

The Federal Communications Commission (FCC) requires all companies that send text messages to 10-digit numbers (10DLC) to be verified entities with legitimate reasons to text through The Campaign Registry (TCR). Unsolicited texts sent to consumers via Business to Person (B2P) or Application to Person (A2P) texting are illegal in all cases; it doesn’t just apply to marketing/sales campaigns. Consumers must opt-in to receive communications from B2P or A2P texting. Opt-in must be 1 to 1 (customer to agency), can’t be shared with third parties, and can’t be implied.
